L\u2019employ\u00e9<sup>1<\/sup> cong\u00e9di\u00e9 qui estime son licenciement abusif doit former opposition par \u00e9crit aupr\u00e8s de l\u2019employeur. Mais il arrive que la lettre d\u2019opposition demande en outre une copie du dossier personnel de l\u2019int\u00e9ress\u00e9. Une telle sollicitation peut \u00eatre embarrassante pour l\u2019employeur, qui se demandera quelle suite il convient d\u2019y donner. Les dispositions de la loi f\u00e9d\u00e9rale sur la protection des donn\u00e9es (LPD), qui s\u2019appliquent en mati\u00e8re de contrat de travail<sup>2<\/sup><\/span><span style=\"font-weight: 400;\">, pr\u00e9voient en effet que l\u2019employ\u00e9 a un droit d\u2019acc\u00e8s \u00e0 toutes les donn\u00e9es le concernant qui sont contenues dans son <\/span><i><span style=\"font-weight: 400;\">fichier<sup>3<\/sup><\/span><\/i><span style=\"font-weight: 400;\">, lequel se d\u00e9finit comme l\u2019ensemble des donn\u00e9es personnelles dont la structure permet de rechercher les donn\u00e9es par personne concern\u00e9e<sup>4<\/sup><\/span><span style=\"font-weight: 400;\">. Pour le surplus, ni la LPD ni le code des obligations ne d\u00e9finissent ce qu\u2019il faut comprendre par le <\/span><em>dossier personnel<\/em><span style=\"font-weight: 400;\"> d\u2019un collaborateur, dont la constitution n\u2019est d\u2019ailleurs pas express\u00e9ment exig\u00e9e en droit suisse.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Dans le canton de Vaud, il existe une d\u00e9finition applicable aux rapports de travail entre l\u2019Etat et ses collaborateurs\u00a0: le <\/span><em>dossier personnel<\/em><span style=\"font-weight: 400;\"> recouvre le contrat et ses avenants, le cahier des charges, les documents d\u2019entretien d\u2019appr\u00e9ciation, l\u2019attestation des cours de formation continue, les documents \u00e9chang\u00e9s et les \u00e9ventuelles d\u00e9cisions, ainsi que toute autre pi\u00e8ce concernant le collaborateur et son activit\u00e9<sup>5<\/sup><\/span><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\">Par analogie avec le droit vaudois de la fonction publique, l\u2019on peut raisonnablement consid\u00e9rer que les \u00e9l\u00e9ments ci-dessus doivent \u00eatre fournis \u00e0 l\u2019employ\u00e9 qui le souhaite, m\u00eame si ces \u00e9l\u00e9ments ne sont pas nomm\u00e9ment indiqu\u00e9s dans la requ\u00eate et si l\u2019employ\u00e9 les a d\u00e9j\u00e0 re\u00e7us. A noter que la loi n\u2019exige pas que les \u00e9l\u00e9ments du dossier personnel soient r\u00e9unis dans un seul dossier et dans un seul endroit\u00a0; ces \u00e9l\u00e9ments peuvent se trouver \u00e0 plusieurs emplacements et sous plusieurs formats.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Mais certains \u00e9l\u00e9ments ne sont pas accessibles \u00e0 l\u2019employ\u00e9. Selon la LPD, il s\u2019agit d\u2019abord des donn\u00e9es personnelles qui sont trait\u00e9es pour un usage exclusivement personnel et qui ne sont pas communiqu\u00e9es \u00e0 des tiers<sup>6<\/sup><\/span><span style=\"font-weight: 400;\">. La doctrine enseigne qu\u2019il s\u2019agit de tous les \u00e9changes internes, par exemple de notes ou d\u2019outils d\u2019aide \u00e0 la d\u00e9cision concernant la gestion de la carri\u00e8re d\u2019un employ\u00e9 ou la gestion de conflit, m\u00eame s\u2019ils font l\u2019objet de lettres ou d\u2019emails, voire des notes personnelles du recruteur, du sup\u00e9rieur hi\u00e9rarchique ou d\u2019autres collaborateurs<sup>7<\/sup><\/span><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">A c\u00f4t\u00e9 de cela, la loi pr\u00e9voit que la communication de certains renseignements peut \u00eatre refus\u00e9e ou restreinte, voire diff\u00e9r\u00e9e, dans la mesure o\u00f9 les int\u00e9r\u00eats pr\u00e9pond\u00e9rants d\u2019un tiers ou du ma\u00eetre du fichier l\u2019exigent<sup>8<\/sup><\/span><span style=\"font-weight: 400;\">. La doctrine cite les documents r\u00e9v\u00e9lant les intentions strat\u00e9giques de l\u2019employeur, par exemple des documents relatifs \u00e0 la planification des <\/span><span style=\"font-weight: 400;\">besoins en personnel, aux plans de carri\u00e8re ou \u00e0 sa strat\u00e9gie de d\u00e9fense en cas de conflit avec un employ\u00e9<sup>9<\/sup><\/span><span style=\"font-weight: 400;\">. L\u2019on peut aussi imaginer un audit financier contenant des secrets d\u2019affaires, un rapport d\u2019un d\u00e9tective priv\u00e9 mettant en cause d\u2019autres personnes, la d\u00e9nonciation \u00e9manant d\u2019une victime de mobbing ou encore le signalement d\u2019un whistleblower dont l\u2019anonymat doit \u00eatre pr\u00e9serv\u00e9.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">La demande d\u2019acc\u00e8s aux donn\u00e9es personnelles ne doit pas constituer un abus de droit. Tel sera le cas lorsque qu\u2019elle ne r\u00e9pond \u00e0 aucun int\u00e9r\u00eat digne de protection, qu\u2019elle est purement chicani\u00e8re ou qu\u2019elle doit servir des int\u00e9r\u00eats autres que ceux que la r\u00e8gle est destin\u00e9e \u00e0 prot\u00e9ger. Le droit suisse n\u2019autorise pas les <\/span><i><span style=\"font-weight: 400;\">fishing expeditions<\/span><\/i><span style=\"font-weight: 400;\"> par lesquelles l\u2019employ\u00e9 tente de construire un dossier contre l\u2019employeur en recherchant les faiblesses ou les failles de son dossier<sup>10<\/sup><\/span><span style=\"font-weight: 400;\">. Le Tribunal f\u00e9d\u00e9ral a jug\u00e9 que si la requ\u00eate de l&#8217;employ\u00e9 visant \u00e0 obtenir les donn\u00e9es le concernant en vue d&#8217;une \u00e9ventuelle action en dommages-int\u00e9r\u00eats contre le ma\u00eetre du fichier n&#8217;est, en soi, pas abusive, tel n\u2019est pas le cas d\u2019une requ\u00eate qui ne constitue qu&#8217;un pr\u00e9texte \u00e0 une recherche ind\u00e9termin\u00e9e de moyens de preuve ou d\u2019un droit d\u2019acc\u00e8s exerc\u00e9 dans le but exclusif d&#8217;espionner une partie adverse et de se procurer des preuves normalement inaccessibles<sup>11<\/sup><\/span><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Les renseignements sont fournis dans un d\u00e9lai de 30 jours d\u00e8s la r\u00e9ception de la demande. Il en va de m\u00eame d\u2019une d\u00e9cision restreignant le droit d\u2019acc\u00e8s pour les raisons indiqu\u00e9es ci-dessus. Si les renseignements ne peuvent pas \u00eatre donn\u00e9s dans les 30 jours, l\u2019employeur doit en avertir l\u2019employ\u00e9 en lui indiquant le d\u00e9lai dans lequel interviendra sa r\u00e9ponse<sup>12<\/sup><\/span><span style=\"font-weight: 400;\">. En cas de litige relevant de la comp\u00e9tence des autorit\u00e9s vaudoises, l\u2019employ\u00e9 peut saisir le tribunal de prud\u2019hommes en invoquant l\u2019article 328b CO ou le pr\u00e9sident du tribunal d\u2019arrondissement qui est comp\u00e9tent pour les d\u00e9cisions relatives au droit d\u2019acc\u00e8s aux donn\u00e9es personnelles, que ce soit dans les rapports de travail ou dans un autre contexte<sup>13<\/sup><\/span><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14pt; font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">D\u2019une mani\u00e8re g\u00e9n\u00e9rale, nous ne sommes gu\u00e8re enclin \u00e0 donner suite \u00e0 une demande de fournir, sans autre pr\u00e9cision, l\u2019ensemble du dossier personnel, dans la mesure o\u00f9 une sollicitation aussi vague s\u2019apparente \u00e0 une <\/span><i><span style=\"font-weight: 400;\">fishing expedition<\/span><\/i><span style=\"font-weight: 400;\"> prohib\u00e9e. De m\u00eame, la requ\u00eate tendant \u00e0 la production de documents que l\u2019employ\u00e9 poss\u00e8de manifestement d\u00e9j\u00e0 (bulletins de salaire r\u00e9guli\u00e8rement envoy\u00e9s, contrats et avenants \u00e9tablis en deux exemplaires originaux, courriers ou emails \u00e9chang\u00e9s, etc.) devrait \u00eatre consid\u00e9r\u00e9e comme chicani\u00e8re, sauf \u00e0 l\u2019int\u00e9ress\u00e9 d\u2019indiquer pr\u00e9cis\u00e9ment quels documents ont \u00e9t\u00e9 \u00e9gar\u00e9s. Il en va de m\u00eame de documents qui sont demand\u00e9s dans le seul but de v\u00e9rifier si l\u2019employeur les poss\u00e8de toujours (lettres d\u2019avertissement, demandes de cong\u00e9, relev\u00e9s de vacances, etc.). A notre avis, l\u2019employeur devrait aussi s\u2019opposer \u00e0 la production de tout document de nature interne comme des notes personnelles ou des emails \u00e9chang\u00e9s entre collaborateurs, m\u00eame s\u2019ils ont un lien avec le requ\u00e9rant. Le droit d\u2019acc\u00e8s aux donn\u00e9es personnelles ne conf\u00e8re pas le droit \u00e0 un employ\u00e9 de prendre connaissance ou de v\u00e9rifier tout ce qui se passe \u00e0 l\u2019int\u00e9rieur de l\u2019entreprise qui l\u2019a occup\u00e9. Dans la m\u00eame veine, ce droit ne doit pas permettre \u00e0 l\u2019employ\u00e9 de reconstituer son parcours professionnel, par exemple par la remise de documents (courriers, contrats, rapports, factures, etc.) qu\u2019il a re\u00e7us ou \u00e9tablis en ex\u00e9cution de ses t\u00e2ches\u00a0; de tels documents, qui appartiennent \u00e0 l\u2019employeur, ne rel\u00e8vent pas des donn\u00e9es personnelles au sens de la LPD.<\/span><\/span><\/p>\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row type=&#8221;in_container&#8221;
